PLANT CLOSING AND MASS LAYOFF NOTICE REQUIREMENTS

Summary
- Limits the adverse effects of plant closings and mass layoffs on employees and communities.
- Applies to all employers with 100 or more employees.
- Covered employers required to give employees 60 days’ advance notice of plant closings which result in loss of employment for 50 or more employees, or mass layoffs which result in loss of employment for 500 or more employees, or in loss of employment for 50 employees and one-third of the workforce.
- Notice must be given to union officer (if applicable), individual employees affected, state agency, and local government official.
- In particular circumstances, notice may not be required. Abbreviated notice allowed in some circumstances.
- Employers in violation may be liable for 60 days’ back pay and benefits to each affected employee, a $500 per day penalty, and attorneys’ fees.
